These Rules apply to the Sweepstakes operated by Audio Advice (the “Sweepstakes”). Entry into the Sweepstakes constitutes your acceptance of these Rules.

PRIZE: The prize package will be announced in the coming weeks. We will notify entrants of the prizes via email & social media, as well as update these terms once the prizes have been announced. Entrant(s) are solely responsible for all expenses, costs or fees associated with the acceptance and/or use of the prizes specified in these Rules as being offered, including, without limitation, any and all taxes (if any). ELIGIBILITY: To be eligible to enter and qualify, each entrant must be a U.S. legal resident. As of the entry date, the entrant must be at least 18 or the age of legal majority in the entrant’s state. When participating in the Sweepstakes, an opportunity to sign up to receive additional information from Audio Advice may be available. Entrants are subject to all notices posted online, including, but not limited to Audio Advice’s Privacy Policy and Terms of Use. Entrants may need to provide proof of residency upon request. Employees of Audio Advice and their immediate families (spouse, parent, child, sibling, and their respective spouses, regardless of where they reside) or those living in the same household (whether or not related) are not eligible to enter or qualify.

HOW TO ENTER AND QUALIFY: By entering, each entrant agrees to be bound by these Rules.

Each entrant may enter the Sweepstakes beginning at 6:00 pm Eastern Time (“ET”) December 3, 2020 and ending Thursday, 4:59 pm ET January 7, 2020 by joining the Audio Advice mailing list. By joining the Audio Advice mailing list, you agree to receive news & promotions from Focal.

All submissions received before Thursday, 4:59 pm ET January 7, 2020 will be entered into the Sweepstakes. In total, each individual can submit one (1) entry into the Home Theater Giveaway. We will notify entrants of the prizes via the Happy Hour Livestream on the final day of the giveaway, as well as update these terms once the prizes have been announced. Entrant(s) are solely responsible for all expenses, costs or fees associated with the acceptance and/or use of the prizes specified in these Rules as being offered, including, without limitation, any and all taxes (if any). Any additional entries will be rejected.

For purposes of these Rules, “receipt” will occur when the servers operated by Audio Advice record the entry information resulting from an entrant’s entry being received. Any automated computer receipt (such as one confirming delivery of email) does not constitute proof of actual receipt by Audio Advice for the purposes of these Rules. Mass entries generated by a script, macro or use of automated devices will be disqualified.

Submission of an incomplete or improper entry may result in disqualification. Audio Advice shall not be responsible for lost or misdirected messages, unavailable network connections, failed, incomplete, garbled or delayed computer transmissions, online failures, hardware, software or other technical malfunctions or disturbances or other communications failures or circumstances affecting receipt of entries or entrants’ ability to participate in the Sweepstakes. Audio Advice reserves the right to permanently disqualify any person it believes has intentionally violated these Rules.

Entrant(s) will be selected at random. Odds of winning depend upon the number of entries received.

Entrant(s) will be notified by email to the email address provided approximately two days after selection and entrant(s) are required to respond within 7 days of transmission of that notice or risk forfeiting the prize. If the entrant(s) fails to respond within that time period, the prize will be forfeited and may be offered to an alternate entrant(s) from the remaining entrants. In the event of a dispute regarding the identity of the person submitting an online entry, the entry will be deemed submitted by the person in whose name the email account is registered.

Entrant(s) may be required to provide evidence that the entrant is the authorized account holder of the address associated with the qualifying entry and complete an affidavit of eligibility and any applicable releases. By accepting a prize, entrants consent to the use of their names, photographs and/or other likenesses for advertising or publicity purposes without additional compensation, except where prohibited by law. By entering, all entrants release Audio Advice, and its parent companies, affiliates, subsidiaries, vendors, agencies, officers, directors, agents, employees, suppliers and all others associated with the development or execution of the Sweepstakes from any and all liability with respect to, or in any way arising from, the Sweepstakes or the acceptance, possession or use of any prize including, without limitation, liability for any personal injury, damage or loss.

USE OF ENTRANT INFORMATION: As permitted by law and in accordance with Audio Advice’s Privacy Policy, Audio Advice may use information which all entrants provide about themselves to send them announcements about Audio Advice’s products and programs via electronic and ordinary mail. An entry, except where prohibited by law, constitutes a grant of permission to Audio Advice or its agents to include entrants’ names on the websites of Audio Advice and in connection with a Winner’s List without further notice.

Winners may only win once every 365 days.

PRIZES: The winner is solely responsible for all expenses, costs or fees associated with the prize.

UNFORESEEN EVENTS: Audio Advice, in its sole discretion, reserves the right to terminate the Sweepstakes at any time, including, without limitation, if Audio Advice becomes aware of any occurrence which would materially affect the promotion’s security or fairness, including but not limited to technical malfunction of the Sweepstakes Landing Page, software, and/or hardware transmission failures, and virus contamination.

CHOICE OF LAW, VENUE AND LIMITATIONS: ANY CLAIMS OR CONTROVERSIES RELATING TO OR ARISING FROM ANY CONTEST SHALL BE GOVERNED BY AND INTERPRETED IN ACCORDANCE WITH THE LAWS OF THE STATE OF NORTH CAROLINA WITHOUT REGARD TO THE CONFLICTS OF LAW PRINCIPLES THEREOF AND SHALL BE BROUGHT IN THE STATE AND FEDERAL COURTS LOCATED IN RALEIGH, NORTH CAROLINA. EACH ENTRANT AGREES TO THAT VENUE AND JURISDICTION AND THE EXCLUSIVE JURISDICTION OF THOSE COURTS AND WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THOSE COURTS. Under no circumstances will any entrant be permitted to obtain awards for, and contestant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than contestant’s actual out-of-pocket expenses (i.e., costs associated with entering the Sweepstakes), and contestant (or, if an eligible minor, his/her parent or legal guardian) further waives all rights to have damages multiplied or increased.
